The “Policy Development Manual” and the templates are available for Trust staff to view and download on the Trust’s intranet. If Trust staff need any further advice or support, please email policies@sssft.nhs.uk.

Claims Management Policy

A claim is defined as ‘a demand for compensation made following an adverse incident resulting in damage to property and/or personal injury’. From a clinical perspective this also includes ‘allegations of clinical negligence and/or a demand for compensation made following an adverse clinical incident resulting in personal injury, or any clinical incident which carries significant litigation risk for the Trust’.

 

The Trust is committed to the effective and timely investigation of, and response to, any financial loss, claim or potential claim including those involving allegations of clinical negligence or personal injury.  All personal injury claims received by the Trust, relating to the services it provides and the individuals it employs will be dealt with in accordance with the relevant scheme, “Clinical Negligence and Personal Injury Litigation; Provisions, Contingent Liabilities and Contingent Assets”; the Clinical Negligence Scheme for Trusts, the Liability To Third Party Scheme and Property Expense Scheme (PES) reporting guidelines and the Pre-action Protocol for Personal Injury Claims.
